Our practical view

What the development means

  • A foreign business may have a UAE fixed establishment even without owning premises—for example, where its employees regularly work from a UAE client's premises using technology resources.
  • Registrants subject to UAE e-invoicing must issue and transmit tax invoices and credit notes in the prescribed structured electronic form. An electronic invoice must still satisfy the VAT invoice requirements.
  • For concerned goods or services imported on or after 1 January 2026, a taxable person no longer needs to issue a tax invoice to itself under the reverse charge mechanism, but must account for VAT and retain supporting documents.
  • A VAT credit balance must be refunded or used within five years from the end of the tax period in which the excess recoverable tax arose; otherwise, the unused balance lapses.
  • The FTA may reject input VAT where a supply or wider supply chain is connected to tax evasion and the taxpayer knew, or should have known, of that connection.

What is VATP046?

VATP046 consolidates and explains the principal amendments made to Federal Decree-Law No. 8 of 2017 by Federal Decree-Law No. 16 of 2024 and Federal Decree-Law No. 16 of 2025. It states the FTA's position; it does not create a new law or change the effective dates of the underlying amendments.

Electronic invoicing and input VAT

The law now defines the Electronic Invoicing System, Electronic Invoice and Electronic Credit Note. Where an electronic tax invoice is required or issued through the system, retaining it is a condition for recovering the related input VAT.

A normal PDF is not automatically a structured Electronic Invoice, and an Electronic Invoice is not automatically a valid Tax Invoice unless the Executive Regulation requirements are met.

Reverse charge on imported goods and services

From 1 January 2026, the requirement to issue a tax invoice to oneself for imported concerned goods and concerned services is removed. The importer must still account for VAT and retain supporting records. Imports before that date remain subject to the earlier position explained in VATP044 and VATP045.

Five-year deadline for VAT credits

After the FTA offsets excess recoverable VAT against payable tax and administrative penalties, any remaining excess may be refunded. The taxpayer has five years from the end of the tax period in which the excess arose to request a refund or use the credit. Any unused balance then lapses, even if part of the original credit was used earlier.

Input VAT and tax-evasion risk

Article 54 bis allows the FTA to reject input VAT where a supply or part of the wider supply chain is related to tax evasion and the taxpayer knew or should have known. A taxpayer may be treated as having been required to know if it did not verify the validity and integrity of the supplies before claiming input VAT.

Practical application

Examples

VAT credit expiry

Facts: A return for the period ending 31 January 2026 creates an AED 120,000 credit. AED 45,000 is later used, leaving AED 75,000.

VAT result: The company must use or request a refund of AED 75,000 by 31 January 2031. Otherwise, the unused credit lapses.

Reverse charge after 1 January 2026

Facts: A Dubai consultancy receives an AED 200,000 overseas service in February 2026, subject to reverse charge at 5%.

VAT result: It accounts for AED 10,000 output VAT and may recover AED 10,000 input VAT subject to normal conditions. No self-issued invoice is needed, but supporting records remain mandatory.

Supplier verification

Facts: A trader receives an unusually discounted AED 500,000 invoice plus AED 25,000 VAT. Payment is requested to an unrelated personal account and delivery evidence is incomplete.

VAT result: The red flags should be investigated before claiming AED 25,000 input VAT. The FTA may reject the deduction if the supply chain is linked to evasion and the trader knew or should have known.

Foreign business fixed establishment

Facts: A foreign technology company's employees regularly work from a UAE client's premises using laptops and phones, although the company has no UAE office.

VAT result: The personnel and technology resources may create a UAE fixed establishment. The company's VAT status and transaction treatment should be reviewed.

PDF versus structured e-invoice

Facts: A business emails a normal PDF invoice after it becomes subject to the prescribed UAE Electronic Invoicing System.

VAT result: A PDF alone may not qualify as a structured Electronic Invoice. Invoice data must be issued and transmitted through the prescribed system while meeting all tax-invoice requirements.

Recommended actions

What UAE businesses should do now

  • Prepare an ageing schedule of VAT credit balances by the tax period in which each balance arose and set alerts before the five-year deadline.
  • Update reverse-charge procedures for imports from 1 January 2026 while retaining contracts, invoices, customs records and evidence supporting the VAT treatment.
  • Strengthen supplier onboarding and review controls, including TRN, trade licence, bank-account ownership, commercial rationale, invoice consistency and receipt evidence.
  • Assess whether foreign personnel regularly working from UAE premises and using UAE resources could create a fixed establishment for VAT purposes.
  • Review ERP readiness for structured UAE e-invoices and electronic credit notes; a PDF invoice by itself is not necessarily a compliant electronic invoice.
  • Train finance and procurement teams to escalate unusual pricing, payment instructions, invoice patterns or supplier documentation before input VAT is claimed.

Frequently asked questions

When was VATP046 issued?

The FTA VAT guidance library records the issue date as 4 September 2026. It explains amendments effective from 30 October 2024 and 1 January 2026.

Are self-issued invoices still required under the reverse charge?

Not for concerned goods and services imported on or after 1 January 2026. VAT accounting and supporting-document requirements continue.

Can an old UAE VAT credit balance expire?

Yes. The five-year period runs from the end of the tax period in which the excess recoverable VAT arose.

Can input VAT be denied because of a supplier's tax evasion?

Yes, where the supply chain is linked to tax evasion and the taxpayer knew or should have known. Transaction and supplier verification are essential.

Is a PDF invoice a UAE electronic invoice?

Not necessarily. VATP046 describes structured invoice data capable of automatic electronic processing through the prescribed system, while all VAT invoice requirements must still be satisfied.
